Introduction

WanderOn Experiences Private Limited is a company incorporated under the Companies Act, 2013. We're excited to help you explore the world through our curated group tours, custom holidays, backpacking and biking trips across India and International destinations. These Terms of Use and Booking Conditions explain how our services work, what you can expect from us and what we ask of you in return.

By booking a trip or using our platform, you agree to these terms-

  • PART A: General Platform Use & Terms of Service
  • PART B: Travel Service Terms & Conditions
  • PART C: Legal Relationship & User Agreement

They cover important details like payments, cancellations, responsibilities and how we handle things like changes or unforeseen events. These Terms constitute a binding legal agreement between you and WanderOn Experiences Private Limited governed by the laws of India.

WanderOn acts as your travel organizer working with trusted third-party providers like airlines, hotels and local transport. While we coordinate everything for you, the actual services are delivered by independent partners which means there are certain things beyond our control.

We encourage you to read through this document before you use our platform or confirm your trip. It's designed to be clear and helpful so you know exactly what to expect and can travel with confidence.

PART A: GENERAL PLATFORM USE & TERMS OF SERVICE

This section governs your use of WanderOn's website, booking channels, WhatsApp support and related digital services. It outlines the basic rules for accessing our platform, what conduct is expected from users and the terms under which your access may be limited or terminated.

1. Client Responsibility

By accessing or using WanderOn's website, WhatsApp support line or by confirming a booking with us through any channel you acknowledge and agree to be bound by these terms. These Terms apply to all users regardless of how they interact with our services whether digitally, in person or through an authorized agent. If you do not agree with any part of this Agreement, we request that you refrain from proceeding with a booking or engaging with our services.

Clients are advised to check the description of the services and products carefully before making a booking. Client agrees to be bound by all the conditions as contained in booking confirmation or as laid out in the confirmed booking voucher. These conditions are also to be read in consonance with the terms and conditions of services.

The services are provided on an "as is" and "as available" basis. WanderOn may change the features or functionality of the services being provided at any time, in its sole discretion, without any prior notice. WanderOn expressly disclaims all warranties of any kind, whether express or implied including but not limited to the implied warranties of merchantability reasonably fit for all purposes. No advice or information whether oral or written which the User obtains from WanderOn or through the services opted shall create any warranty not expressly made herein or in the terms and conditions of the services.

2. Definitions

For the purposes of these Terms, the following terms shall have the meanings assigned below, unless the context requires otherwise:

"Company / we / our / us" refers to WanderOn Experiences Private Limited, a travel organizer and booking facilitator that offers curated travel experiences through its website, customer support platforms and authorized representatives.
"Independent Contractor" refers to any third-party service providers such as airlines, hotels, transport companies, visa agents or destination partners who are engaged by the Company to deliver specific services but operate independently.
"Long-Haul Destinations" refer to extended or intercontinental travel locations typically including but not limited to Europe, United Kingdom, Scotland, Ireland, United States, Canada, Japan, South Korea, Turkey, Egypt, Australia, New Zealand, South Africa, Kenya, South America, Jordan, Israel and other similar regions.
"Non-Refundable Services" refer to bookings for services such as flights, hotel rooms, visa fees or tickets, etc. which once confirmed are not eligible for refund under any circumstances due to supplier rules.
"Platform" refers to all digital channels owned or operated by the Company including but not limited to the website, WhatsApp number, email communications and mobile interfaces through which services are offered.
"Services" means all travel-related services offered by the Company including group tours, customized holidays, backpacking and biking trips, flight and visa facilitation, hotel bookings, transport arrangements and other travel assistance.
"Short-Haul Destinations" refer to nearby or regional travel locations typically including but not limited to India (Domestic), Bhutan, Nepal, Sri Lanka, Thailand, Singapore, Bali, Dubai, Kazakhstan, Azerbaijan, Vietnam, Malaysia, Maldives, Mauritius and other similar regions.
"Tour or Package" refers to any domestic or international trip, travel package or service experience curated or coordinated by the Company.
"User / Client / You / Traveller" refers to any person who visits our website, communicates with our team or makes a booking with us either for themselves or on behalf of others.

3. Eligibility to Use

By accessing or using WanderOn's platform or services, you confirm that:

  • You are at least 18 years of age and have the legal capacity to enter into binding contracts, or
  • You are acting as a parent/legal guardian for a minor or on behalf of another individual or group with proper authorization.

You also agree that any information provided by you whether for yourself or on behalf of others is accurate and submitted with full consent and lawful authority. WanderOn reserves the right to restrict or deny access to any user who does not meet these eligibility conditions or who violates these Terms of Use.

4. Use of Platform & Communication Channels

WanderOn provides access to its services through various digital and direct communication channels including our official website, booking forms, email, WhatsApp support line and authorized representatives. By engaging with us through any of these platforms, you agree to use them only for lawful, genuine and non-commercial purposes. You are responsible for ensuring that the information you provide while interacting with our team or platform is accurate, up-to-date and complete.

We may send important communications including booking confirmations, payment reminders, cancellation notices and updates via WhatsApp, SMS, email or phone call. By initiating a query or booking with us you acknowledge and consent to receiving such transactional communications from our team. Please ensure that the mobile number and email ID you provide are valid and accessible to you. While we strive to maintain accuracy in all digital communications, we are not liable for any delay, loss or miscommunication caused by incorrect or outdated contact information submitted by you.

5. Permitted and Prohibited Conduct

When using WanderOn's services or communicating through our platforms, we expect respectful, lawful and responsible behaviour.

You are permitted to:

  • Make genuine travel inquiries and bookings for yourself or authorized persons.
  • Communicate with our team for support, guidance or trip-related needs.
  • Share accurate and complete information necessary for booking or documentation.

You are not permitted to:

  • Submit false bookings, impersonate others or use fake contact information.
  • Use our website or WhatsApp for spamming, harassing staff or spreading misinformation.
  • Attempt to interfere with the technical functioning of our platform.
  • Use our content (itineraries, pricing, images, etc.) for commercial or competitive purposes without permission.

Misuse of any kind may result in cancellation of your booking, denial of future services or legal action if required.

6. Termination or Suspension of Access

WanderOn reserves the right to suspend, restrict or permanently terminate your access to its platform or services without prior notice if:

  • You violate these Terms or applicable laws.
  • You provide false, incomplete or misleading information.
  • You misuse the platform or harass our staff or representatives.
  • Your conduct causes harm to WanderOn's reputation, partners or other users.

In such cases, any future bookings may be denied and any ongoing services may be cancelled without liability or refund. We also reserve the right to take appropriate legal action, if necessary. Termination or suspension will not affect any rights or obligations that accrued prior to such action including any payment obligations or indemnities due.

PART B: TRAVEL SERVICE TERMS & CONDITIONS

This section outlines the commercial terms governing your travel bookings with WanderOn. It includes details on our services, booking procedures, payments, cancellations and limitations of responsibility as a service provider.

7. Scope of Services

WanderOn offers a range of curated travel services designed for both individual and group travellers. Our services include, but are not limited to:

  • Group Tours: Pre-designed, scheduled trips with fixed itineraries to domestic and international destinations.
  • Customized Holidays: Tailor-made travel plans based on specific preferences, group size, travel goals or budgets.
  • Backpacking & Biking Trips: Adventure-centric trips designed for solo travellers or groups seeking offbeat, budget-friendly or high-energy experiences.
  • Visa, Flights & Local Transfers: Coordination support for flight bookings, visa applications and airport/station transfers wherever applicable.

Our offerings span a wide selection of domestic and international locations, across both Short-Haul and Long-Haul Destinations as defined in these Terms. The categorization of destinations as Short-Haul or Long-Haul is indicative and may be updated periodically based on evolving travel routes, vendor arrangements or operational feasibility.

While WanderOn coordinates all aspects of your travel experience, many components such as flights, hotels, ground transport and activities are delivered by third-party service providers. WanderOn acts as a facilitator and organizer not as the direct operator of these services.

8. Booking Process & Contract Formation

Booking Initiation & Confirmation:

To initiate your booking, you must provide your travel preferences and confirm itinerary details through WanderOn's official platform or authorized communication channels (including WhatsApp or direct coordination with our representatives).

  • You have accepted the proposed itinerary and package terms;
  • The required booking deposit (as per the applicable Payment Policy) has been received by WanderOn; and
  • You have received a formal booking confirmation from WanderOn via written communication.

Your booking is considered confirmed only when:

All quotes and package inclusions are tentative and subject to availability at the time of final payment. In the event of any changes to confirmed services (such as flight schedules, hotels or activities), WanderOn will inform you within 72 working hours of such occurrence excluding weekends and public holidays.

Booking made on behalf of Others:

If you are placing a booking on behalf of other travellers you confirm that:

  • You are legally authorized to do so;
  • You accept responsibility for ensuring that the traveller(s) are aware of and accept these Terms & Conditions; and
  • WanderOn may communicate with you as the single point of contact for all matters related to the booking.

Right to accept or reject Bookings:

WanderOn reserves the absolute right to accept, reject or cancel any booking request at its sole discretion including after initial payment especially in case of suspected misuse, inaccurate information or unavailability of services. In such cases, payments made will be refunded subject to applicable non-refundable conditions.

9. Payment Policy

All payments for travel packages must be made in accordance with the timelines and terms outlined below. Payment obligations become binding upon confirmation of booking and any failure to comply may result in cancellation or forfeiture of the booking at WanderOn's discretion.

Short-Haul Packages – Payment Schedule

The following payment terms shall apply to all short-haul destinations:

Long-Haul Packages – Payment Schedule

The following payment terms shall apply to all long-haul destinations:

Mode of Payment:

WanderOn accepts the following modes of payment:

  • UPI
  • Net banking / bank transfers
  • Credit and debit cards
  • Cash (in rare cases subject to prior approval)
  • Cheque (accepted only upon prior confirmation and subject to realization)

All payments must be made in Indian Rupees (INR). For international packages, the applicable Rate of Exchange (ROE) on the date of final payment will apply.

Note: Any increase in the price charged by WanderOn on account of change in rate of taxes or imposition of new taxes, levied by Government shall have to be borne by the client. Such imposition of taxes, levies may be without prior notice and could also be retrospective but will always be as per applicable law.

Please note that foreign exchange rates are subject to fluctuation. Any difference in the exchange rate between the date of booking and the date of final payment will be applicable and the final amount will be calculated based on the Rate of Exchange (ROE) on the actual date of payment.

Non-Refundable Services:

Certain components of the tour package are non-refundable and must be paid in full at the time of booking. These include but are not limited to Visa fees, special hotel deposits, event tickets or activity add-ons governed by third-party terms. Such components are non-transferable and not eligible for refund irrespective of whether the main tour qualifies for partial refunds or credit notes. These terms are enforced by the respective service providers and are beyond WanderOn's control.

LRS (Liberalized Remittance Scheme) Compliance & PAN Requirements:

In accordance with Reserve Bank of India (RBI) regulations under the Liberalized Remittance Scheme (LRS), all international bookings made through WanderOn's website or sales channels require valid PAN details of the traveller. It is the responsibility of the traveller to furnish the correct PAN information either at the time of booking or by the deadline communicated by WanderOn. In the case of minors, PAN of a parent or guardian is mandatory.

The traveller confirms that the total foreign exchange remitted or purchased during the ongoing financial year, including this transaction remains within the permissible limits prescribed by the RBI. In case the traveller's foreign exchange usage exceeds the threshold before WanderOn processes the booking or remittance through its banking partner, WanderOn will be compelled to cancel the booking and process a refund in line with its applicable cancellation policy. The traveller also confirms that any foreign exchange purchased under this booking will be strictly used for the purpose of international travel as declared.

For compliance and verification purposes, the User authorizes WanderOn to retrieve PAN details of the traveller from prior bookings, user profiles or share relevant information with third-party service providers strictly for validation purposes. WanderOn will never collect PAN without user consent. If the traveller wishes to opt out of providing PAN details or delete previously submitted information such requests may be raised via authorised communication channels of WanderOn.

Tax Collected at Source (TCS) Compliance:

In accordance with Section 206C(1G)(b) of the Income Tax Act, 1961, the client shall be liable to pay Tax Collected at Source (TCS) on the purchase of any overseas tour package, at the applicable rate, over and above the base package price. WanderOn shall collect this TCS amount from the client, deposit it with the Government of India and issue the necessary certificate or document as proof of such deduction.

The client is required to furnish a valid Permanent Account Number (PAN) for each traveller at the time of booking. WanderOn will verify the PAN to ensure compliance with Section 206CC of the Act. In case the PAN is found to be invalid, incorrect or not associated with the traveller(s), WanderOn reserves the right to cancel the booking in accordance with applicable laws. Any refunds arising out of such cancellations shall be governed strictly by WanderOn's cancellation policy.

Further, clients may also be required to submit a duly filled TCS Declaration Form as may be prescribed by WanderOn from time to time to facilitate compliance and enable accurate reporting to tax authorities.

The Client shall indemnify and hold WanderOn and its representatives harmless from any liabilities, penalties, interest or legal consequences arising due to false, misleading or incomplete declarations or non-compliance with the provisions related to Liberalized Remittance Scheme (LRS) and Section 206C(1G) of the Income Tax Act, 1961 related to Tax Collected at Source (TCS). This includes but is not limited to incorrect disclosure of PAN, residency status, purpose of travel or source of funds.

Payment Conditions & Forfeiture:

The payment policy outlined above is strictly non-negotiable and travellers are required to comply with the amounts and timelines prescribed above. No deviation from the payment structure will be accepted unless specifically agreed to by WanderOn in writing.

However, payment timelines may be subject to variation based on destination-specific requirements, peak travel periods, special events or supplier-imposed deadlines. Travellers must confirm the applicable schedule with their assigned travel consultant before booking.

Unauthorised Payments & Information Security:

All payments towards WanderOn trips and related services must be made only to official WanderOn bank accounts as duly communicated by our authorized representatives. WanderOn does not authorize any employee, agent, or third party to accept payments in personal or unofficial accounts. Clients understand and agree that WanderOn shall not be held liable for any loss or claim arising from payments made to:

  • Any account not legally held in the name of WanderOn Experiences Private Limited.
  • Any individual's personal account even if such a request is made by someone claiming to represent WanderOn.

WanderOn assumes no responsibility for unauthorized transactions and the client waives any right to claim refund or recovery from WanderOn for such transfers.

Clients are further advised to not share sensitive personal information such as credit/debit card numbers, CVV, OTPs, PINs, passwords, or banking credentials with any person, including WanderOn's employees or representatives. In case any such request is received, the client must immediately notify WanderOn through official communication channels. WanderOn shall not be liable for any financial loss, data breach or misuse resulting from the sharing of such sensitive details.

Further, any unauthorised deposits made directly into WanderOn's bank accounts without prior written communication or acknowledgement will be considered invalid. WanderOn is under no obligation to track, verify or apply such deposits. Any such funds may be forfeited without notice and no refund or adjustment shall be entertained in such cases.

10. Modifications & Rescheduling

We understand that plans change sometimes from the traveller's side and at other times due to practical or external circumstances. This clause outlines the terms related to any such modifications whether initiated by you or by WanderOn.

Modifications by Traveller

Eligibility for Rescheduling or Modification:

Clients may request to modify or reschedule their trip subject to the following timelines and conditions:

  • Weekend Trips: Requests must be made at least 15 days prior to the scheduled departure.
  • Domestic Trips: Requests must be made at least 30 days prior to the scheduled departure.
  • International Trips: Requests must be made at least 45 days prior to the scheduled departure.

Permissible Modifications:

Clients may submit written requests for the following modifications:

  • Change of travel dates for the same destination and package.
  • Change of destination.
  • Addition or removal of services (e.g., extra nights, airport transfers).

Important Notes for Rescheduling:

Only one complimentary rescheduling is permitted per booking (within the eligible period).

"Actual cost incurred" refers to non-refundable components such as flight tickets, hotel bookings, permits, and vendor penalties.

Rescheduling is not available for trips booked under non-refundable, limited-period or promotional offers.

All requests are subject to availability, operational feasibility, and vendor approval.

The rescheduled trip must be undertaken within 12 months of the original trip date.

In case of international rescheduling, additional charges may apply for airlines, visas, permits and non-refundable hotels.

Any modification in package inclusions (e.g. room category upgrades, additional services) will be charged at the differential cost.

All requests must be submitted in writing via email or WhatsApp and shall be deemed valid only upon written acknowledgment from the Company.

No changes shall be permitted once the trip has commenced.

For group tours, rescheduling may be denied if minimum group strength is not met on the new dates.

Force Majeure or Medical Rescheduling:

If rescheduling is necessitated by serious illness, accident or force majeure, the client must submit valid supporting documents (e.g. medical certificate, police report). WanderOn may at its sole discretion issue a credit note to the client for future travel use. The decision to accept or deny such requests shall rest solely with WanderOn.

Non-Transferability:

Rescheduled bookings are non-transferable to another individual unless expressly authorized in writing by WanderOn. Name changes on flight tickets are subject to the airline's policies and discretion and may involve additional charges.

Submission and Decision:

All rescheduling and modification requests must be submitted in writing via the official email or WhatsApp business number. WanderOn reserves the right to approve or reject any modification or rescheduling request based on supplier terms, logistical feasibility, and internal policies.

Modifications by WanderOn

In rare circumstances, WanderOn may be required to make changes to your confirmed itinerary, inclusions or dates. This may occur due to factors such as operational issues with third-party vendors, Political unrest, natural disasters, weather-related disruptions or any government or health advisories.

When such changes occur:

We will make best efforts to notify you at the earliest opportunity.

We may offer comparable alternatives of similar value and quality.

In some cases, we may provide a credit note or partial refund depending on the nature of the change and third-party refund policies.

WanderOn will not be liable for indirect losses such as costs of independently booked flights, visas or accommodations affected by such modifications.

Group Tours:

All group tours are subject to a minimum group size of 12 full-paying passengers. If the required group strength is not met or reduces due to last-minute cancellations:

  • WanderOn may offer the traveller an alternate date, tour option or individualised package.
  • In the event of non-acceptance, a credit note or partial refund may be issued strictly for the land portion of the tour.
  • Any non-refundable components such as visa fees, flight tickets or special permits will be deducted as per vendor terms.

By booking with WanderOn, you acknowledge that all tours require a degree of flexibility and operational discretion. While we strive to deliver what was promised, certain modifications may occur due to circumstances beyond our control. Our goal remains to provide the most seamless experience possible under the circumstances.

On-Tour Itinerary Changes:

During the trip, the itinerary may be adjusted due to natural calamities, safety advisories or local regulations. In such cases:

  • WanderOn will make all reasonable efforts to minimise disruptions and ensure an alternate comparable experience.
  • Travellers agree to cooperate with on-ground coordinators understanding that flexibility is essential in group travel.
  • No refunds or credits shall be offered for itinerary changes mandated by external conditions once the tour has commenced.

11. Flight Ticket Issuance & Airline Terms

WanderOn acts solely as a facilitator for flight bookings and does not control the operational or policy-related aspects of any airline. Flight-related services are governed by the respective airline's terms and conditions.

Ticket Issuance & Payment:

Full payment for airfare is mandatory at the time-of-flight ticket issuance. Once issued, flight tickets are airline's fare rules, non-refundable and non-transferable unless allowed by airline policy. Post-issuance changes (including date changes or name corrections) may attract fare differences and amendment charges subject to the airline's discretion.

Airline Responsibilities & Disclaimers:

WanderOn is not liable for any delays, cancellations or rescheduling initiated by the airline. Travellers must coordinate directly with the airline in case of operational changes, check-in issues or denied boarding. Baggage handling is the sole responsibility of the airline. WanderOn will not be held accountable for lost, delayed or damaged baggage during air travel. Any increase in government taxes, fuel surcharges or airline-imposed charges before ticket issuance will be billed to the traveller regardless of the original booking date.

Meals & In-Flight Services:

The inclusion of in-flight meals or beverages depends on the airline and fare type selected. Low-Cost Carriers (LCCs) typically do not include meals, water or checked baggage by default. Travellers are advised to check their specific airline inclusions at the time of booking and manage any add-ons directly with the carrier.

12. Cancellation policy & Credit Note Terms

Cancellation by the Traveller:

All cancellations must be submitted in writing through WanderOn's official communication channels. No cash refunds shall be issued under any circumstances. Where applicable, WanderOn shall only issue a credit note for the recoverable portion of the booking after deducting non-refundable components such as airfare, visa fees, special deposits, insurance and taxes.

All cancellation charges are non-negotiable and will apply even in cases of visa rejection, no-shows, late cancellations, incomplete documentation or inability to travel for any reason. WanderOn is not liable for the refund or recovery of charges imposed by third-party vendors, consulates or authorities.

Short-Haul Packages- Cancellation Schedule

  • At the time of booking: Booking advance (25% of total tour cost) is non-refundable and non-transferable.
  • Within 45 days prior to departure: Minimum deduction of 50% of total tour cost or actual vendor charges incurred whichever is higher.
  • Within 30 days prior to departure: Minimum deduction of 75% of total tour cost, or actual vendor charges incurred whichever is higher.
  • 20 days or less prior to departure: 100% of total tour cost forfeited.

Long-Haul Packages- Cancellation Schedule

  • At the time of booking: Booking advance (INR 40,000/-) is non-refundable and non-transferable.
  • Within 60 days prior to departure: Minimum deduction of 50% of total tour cost or actual vendor charges incurred whichever is higher.
  • Within 45 days prior to departure: Minimum deduction of 75% of total tour cost, or actual vendor charges incurred whichever is higher.
  • 30 days or less prior to departure: 100% of total tour cost forfeited.

Cancellation by WanderOn:

At WanderOn, we are committed to providing seamless travel experiences. However, in the event of a tour being cancelled or rescheduled, the following terms shall apply:

  • Wanderon shall not be held liable for any indirect travel arrangements such as flights, visa processing or insurance that may be affected due to such changes.
  • While we may assist clients in coordinating flight bookings or visa services, these are governed by third-party providers and are typically non-refundable.
  • Therefore, any expenses incurred on flights, visas or insurance whether booked through WanderOn or independently will not be eligible for reimbursement in the event of a tour cancellation or modification.
  • We will endeavour to provide advance notice of any known changes to your tour itinerary to help you make timely and informed decisions.
  • Where possible, WanderOn will assist in coordinating alternative travel solutions. In some cases, we may extend a credit note or partial refund for specific tour components strictly in accordance with vendor refund policies and timelines.
  • In certain situations, arising out of Force Majeure, Wanderon may be required to modify or cancel a tour itinerary. Refunds or credit notes in such cases shall be subject to vendor policies and feasibility. No refunds will be issued for indirect travel services (e.g. flights, visas, insurance) impacted by such changes.

Note:

  • Refunds, if any, on cancelled bookings will always be processed to the respective account or the banking instrument (credit card, wallet etc.) from which payment was made for that booking.
  • In case of cancellation of international trips, the value of credit note/partial refund will be calculated based on the Rate of Exchange (ROE) prevailing on the date of cancellation.

Credit Note Usage:

Credit notes are valid for 12 months from the date of issuance and must be redeemed within this period for a new WanderOn trip. They are non-refundable, non-redeemable for cash and transferable. Credit notes can be redeemed only against WanderOn-operated packages and cannot be applied toward flights, visas, insurance or any third-party services. The entire value must be redeemed in one booking. Partial usage or balance carryover is not permitted unless expressly agreed in writing by WanderOn. Redeemed bookings will be subject to prevailing prices, availability and updated package terms at the time of use. If the new trip cost exceeds the credit note value, the balance must be paid according to the then-applicable payment policy.

13. Travel Insurance & Medical Fitness

Travel Insurance (Strongly Recommended):

WanderOn strongly recommends that all clients obtain comprehensive travel insurance that covers trip cancellations or curtailments; medical emergencies, hospitalization or evacuation; loss, delay or theft of baggage and personal items; flight delays or missed connections; and accidents during adventure or outdoor activities.

Please Note that:

At present, WanderOn does not provide or sell travel insurance directly.

Clients are solely responsible for arranging their own coverage prior to departure.

In the event of cancellation, medical emergency or loss, claims must be made directly to the insurer.

WanderOn will not be liable for any denial of claims or financial losses arising from lack of insurance coverage.

Mandatory Disclosure of Medical Conditions:

Clients must disclose any pre-existing medical conditions or physical limitations that may impact their participation in the tour especially for activities such as hiking, biking or adventure-based travel.

WanderOn reserves the right to:

Request a medical fitness certificate prior to confirming the booking or allowing participation in strenuous components of the itinerary.

Decline participation in activities or trips where medical fitness may pose a safety risk to the client or group.

Failure to disclose relevant medical conditions may result in denial of service or removal from certain tour components, without refund or compensation. If a client fails to disclose a relevant medical condition at the time of booking or prior to departure and an incident occurs during the tour arising from such undisclosed condition, WanderOn shall not be held liable in any manner for injury, loss, delay or disruption caused thereby.

14. Travel Documents, Visas & Client Responsibility

Client Responsibility for travel documents:

Each traveller is solely responsible for ensuring that their passport, visa(s) and other travel permissions are valid, accurate, and compliant with the requirements of the countries included in their itinerary. It is advised that clients consult the official government or embassy website of the destination country to verify the latest entry requirements including visa rules, passport validity, health certifications and other mandatory travel documentation.

Please ensure:

Your passport is valid for at least 6 months from the intended date of return.

You have secured all applicable visas, transit visas or e-visas for your destinations.

You have health documents or vaccination proofs (if required).

You have a government-issued photo ID (for domestic travel within India).

Failure to carry valid documentation may result in denial of boarding or entry for which WanderOn will not be liable.

Visa Assistance & Embassy Discretion:

WanderOn may assist travellers in the visa application process where applicable. However:

  • Visa issuance remains at the sole discretion of the relevant consulate or embassy.
  • WanderOn cannot guarantee visa approvals or the outcome of any application.
  • All expenses incurred in the process are non-refundable regardless of approval status.

OTB Requirement for ECR Passport Holders:

Travellers holding ECR (Emigration Check Required) passports may need to obtain an OTB (OK to Board) clearance depending on the travel destination. Clients are responsible for confirming this requirement and ensuring that it is arranged in advance. WanderOn shall not be responsible for any delays, cancellations or denials of boarding due to failure to meet such requirements.

Review of Documentation:

Travellers are expected to carefully review all documents issued by WanderOn including flight tickets, visa support letters, insurance papers, itineraries and vouchers. Any errors or omissions must be reported immediately. WanderOn shall not be liable for losses or complications arising from failure to notify document issues in a timely manner.

Denial of Entry or Deportation:

If a traveller is denied boarding, refused entry or deported from any country due to incomplete documentation, invalid visa or non-compliance with local immigration rules, WanderOn shall not be held liable for any resulting loss, expense or disruption to the tour.

15. Adventure Activities, Health Requirements & Risk Waiver

Participation in Adventure Activities:

Some tours organized by WanderOn may include optional adventure activities such as hiking, biking, rafting, paragliding, snow sports or water-based excursions. Participation in such activities is entirely voluntary and undertaken at the client's own risk. WanderOn is not liable for any injury, illness, loss or death arising from participation in these activities whether caused by natural factors, personal negligence or third-party service providers.

By choosing to participate in such activities, the traveller confirms that they are physically fit to undertake them. (Medical disclosure responsibilities are covered in Clause 13.)

Compliance with Safety Instructions:

For the safety of all guests:

  • Travellers must strictly adhere to all safety guidelines and instructions issued by WanderOn staff, local guides or third-party operators during the trip.
  • Reckless or non-compliant behaviour that puts the traveller or others at risk may result in immediate removal from the activity or tour without any refund or liability.

Destination Health Requirements:

Clients are responsible for ensuring compliance with entry health protocols of destination countries including required vaccinations or COVID-related documents. WanderOn shall not be liable for entry refusals or missed activities due to non-compliance.

16. Limitation of Role & Independent Contractors

Role of Wanderon as Travel Organizer:

WanderOn acts solely as a travel organizer and booking facilitator on behalf of the client. While we coordinate end-to-end travel packages including flights, accommodation, transportation and sightseeing the actual execution of these services is carried out by independent third-party service providers such as airlines, hotels, transport operators and activity vendors. WanderOn does not own, operate or control any airlines, hotels, transportation companies or sightseeing services directly.

Independent Service Providers:

All components of the tour are sourced from third-party vendors selected in good faith and based on industry reputation. However, WanderOn is not responsible for the actions, errors, negligence or omissions of such independent contractors. Any injury, loss, delay, damage or additional cost arising out of their acts or failures falls outside the scope of WanderOn's direct liability.

Selection Standards & Limitations:

While WanderOn exercises care in selecting its partners, the Company does not guarantee the availability, suitability or flawless performance of every vendor at every destination. By booking with WanderOn, clients acknowledge and accept that certain aspects of the travel experience remain outside our control and agree to release WanderOn from liability in such circumstances.

17. Accommodation Terms

Hotel Check-In & Check-Out:

Standard check-in time is 3:00 PM, and check-out is by 11:00 AM, unless otherwise specified. Early check-in or late check-out is subject to hotel availability and may incur additional charges payable directly by the client.

Room Allocation & Amenities:

Room types, layouts, views, and configurations may vary based on destination and hotel category. Air-conditioned rooms may not be available in certain regions (e.g., Europe or Indian hill stations) where local climate norms apply. Any damages caused by the client to hotel property must be paid for directly at the hotel.

Additional Hotel Charges:

Services such as city tax, mini-bar usage, room service, laundry, or other incidentals are not included in the package and must be paid directly by the traveler to the hotel.

Hotel Changes by WanderOn:

In rare instances due to overbooking, maintenance, or unforeseen circumstances, WanderOn reserves the right to change the hotel to another of similar category. Clients will be informed at the earliest and provided with a suitable alternative.

Specific Room Requests:

Client preferences are treated as requests only and are not guaranteed. Final allocation is at the discretion of the hotel at the time of check-in and subject to availability.

18. Transfers & Sightseeing Services

Scheduled Transfers:

All transfers provided as part of the package are organized as per the tour itinerary and are not available on a disposable or on-call basis. Clients are expected to be punctual for all transfers; delays caused by the client may result in missed services for which no refund or compensation will be provided.

Sightseeing & Transfer Disruptions:

Both sightseeing activities and ground transfers are subject to local conditions such as weather disturbances, road closures, government restrictions, public strikes, or mechanical breakdowns. WanderOn shall not be liable for any missed activities or delays arising from such circumstances beyond our control.

WanderOn's Rights:

WanderOn will make reasonable efforts to ensure smooth service delivery but reserves the right to:

  • Cancel, modify or reschedule activities, transport or sightseeing components due to operational requirements or external factors.
  • Provide alternate arrangements based on feasibility and availability.
No refund or compensation will be provided for missed, unused or curtailed services if they arise from events outside WanderOn's direct control.

Self-Arranged Transfers:

For certain customized tours, clients might need to arrange their own transfers. WanderOn will assist with suggestions and recommendations, but the responsibility for arrangement and timely arrival rests with the client.

Shared vs. Private Transfers:

Group tour transfers and sightseeing are generally shared among participants. Private vehicles or individual transfers can be arranged for an additional charge, subject to availability and local regulations.

19. Luggage & Personal Property Disclaimer

Client Responsibility for Belongings:

Clients are solely responsible for the safety, security and supervision of their personal belongings, valuables and luggage throughout the duration of the tour (including group tour), during travel, hotel stays, transfers and sightseeing.

Wanderon and its representatives shall not be held liable for any:

  • Loss, theft or damage to luggage or personal items (including electronics, cash, passports or jewellery).
  • Belongings misplaced on transport vehicles, at hotels, airports or tourist locations.
  • Items left unattended during check-ins, meals or rest stops.

Porterage & Baggage Handling:

Porterage is generally not provided unless explicitly included in the package. Clients are responsible for arranging porterage directly with the hotel or airport if needed. WanderOn is not responsible for any loss or damage during porterage services provided by third parties.

Airline Baggage Liability:

Airline baggage allowances, restrictions, and liability are governed by the respective airline's policies. WanderOn is not liable for:

  • Baggage delays, misrouting, or loss caused by airlines.
  • Excess baggage charges incurred by the client.
  • Damage to luggage during transit.

Client Advisory: Clients are advised to label their baggage clearly and avoid placing valuables in check-in luggage.

20. Force Majeure

WanderOn shall not be held liable for any failure to perform, delay or change in tour arrangements resulting from circumstances beyond its reasonable control including but not limited to:

  • Natural disasters (earthquakes, floods, hurricanes, landslides, etc)
  • Epidemics or pandemics
  • Strikes, riots, war, or civil unrest
  • Government regulations, travel restrictions, or border closures
  • Technical failures, flight disruptions, or cancellation of transport services
  • Political or civil emergencies impacting the safety or feasibility of travel

In the event of a Force Majeure situation:

  • WanderOn reserves the right to reschedule, modify or cancel part or all of the tour itinerary.
  • Refunds, credit notes or alternate arrangements will be governed by the Cancellation Policy & Credit Note Terms outlined in Clause 12.
  • Any such settlement will depend on third-party vendor policies and the practical feasibility of rescheduling or rerouting services.
Clients acknowledge and accept that no additional compensation, reimbursement or liability shall arise against WanderOn for any disruption, delay or loss caused by Force Majeure events.

PART C: LEGAL RELATIONSHIP & USER AGREEMENT

This section defines the legal relationship between you and WanderOn. It includes your obligations, our liability limitations, dispute mechanisms and other important legal rights and responsibilities.

21. Code of Conduct during Travel

Expected Behaviour:

All clients are expected to maintain respectful and responsible conduct throughout the tour. This includes but is not limited to:

  • Being courteous and considerate to fellow travellers, guides, locals and service providers.
  • Respecting the cultural norms, traditions and laws of the destination country.
  • Complying with safety instructions and tour guidelines issued by WanderOn representatives or local authorities.

Disruptive, unlawful or offensive behaviour may result in the immediate termination of your participation in the tour without any entitlement to a refund or compensation.

Responsibility for Damages:

Clients shall be solely responsible for any loss, damage or disruption caused to property, accommodations, transport or public venues during the course of the trip due to their actions or negligence. WanderOn reserves the right to recover the full cost of such damage or loss either directly or by withholding it from any credit notes or future travel value.

22. Limitation of Liability

WanderOn acts solely as a travel agent and organizer facilitating travel arrangements through independent third-party service providers such as airlines, hotels, transport companies, local guides and other vendors. While we exercise due care in selecting our partners, we do not own, operate or control these third-party services.

  • Any act, omission, negligence or default of independent contractors or service providers;
  • Delays, cancellations, overbooking, force majeure events or any changes in itinerary or accommodations that are outside our direct control;
  • Any personal injury, illness, death, loss of baggage, theft, property damage or financial loss suffered by the client during or as a result of the trip;
  • Any loss or expense arising due to the client's failure to comply with immigration, visa, customs or health regulations.

Accordingly, WanderOn shall not be held liable for:

WanderOn's liability in all circumstances shall be limited to the amount paid by the client for the relevant portion of the services directly organized by WanderOn. No consequential or incidental damages shall be payable under any circumstances.

Clients are strongly encouraged to obtain comprehensive travel insurance to cover unforeseen risks beyond WanderOn's control.

23. Indemnification

By booking a trip or using our services, the client agrees to indemnify, defend and hold harmless WanderOn, its directors, employees, agents and affiliates from and against any and all claims, losses, damages, liabilities, penalties, costs and expenses (including legal fees) arising out of or related to:

  • Any breach of these Terms & Conditions or applicable laws by the client;
  • Any misrepresentation, misconduct, negligence or fraud committed by the client;
  • Any unauthorized use of third-party information, property or services during the course of the trip;
  • Any action or omission by the client that results in damage to persons, property, or service providers;
  • Any claim initiated by a third party due to the client's behaviour, documentation failures, or non-compliance with tour or destination-specific rules.

This indemnity survives the completion of the trip and/or termination of the client's agreement with WanderOn. WanderOn reserves the right to take appropriate legal action to recover any losses resulting from the client's default.

24. Grievance Redressal & Escalation

At WanderOn, client satisfaction is a top priority. We have a structured grievance redressal mechanism in place to ensure that all feedback, concerns or disputes are addressed in a fair and timely manner.

First-Level Support: Customer Success Team:

If you experience any issues before, during or after your travel, you may reach out to our Customer Success Team which is trained to handle trip-related queries and grievances. You can contact us through:

  • Email or the official communication channels provided at the time of booking.
  • WhatsApp (for mid-travel support).
  • Phone support during business hours.

We strive to respond to all grievances within 48 business hours. In certain cases, a dedicated Customer Support Executive may reach out via phone call to understand your concerns in detail and document your point of view.

Escalation Process:

If your concern requires further attention or financial decision-making (such as refunds or credit notes), the issue will be escalated to:

  • The Destination Manager assigned to your group/solo travel program who has contextual knowledge of your tour,
  • Final resolution authority rests with the Vice President - Sales who reviews the case in coordination with the Destination Manager and Customer Success Team.

Refunds, if approved, are typically processed as credit notes and are evaluated on a case-by-case basis keeping in view the company's policies and vendor terms.

Documentation & Timeline:

To assist in resolution, clients are encouraged to retain:

  • Booking confirmations
  • Payment records
  • Screenshots or emails related to the issue

All grievances should ideally be reported within 15 days of tour completion for effective investigation and action.

25. Governing Law, Dispute Resolution & Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India without regard to any conflict of law provisions.

Mutual Amicable Resolution

In the event of any disagreement, controversy or claim arising out of or relating to the services provided by WanderOn or these Terms, the parties shall first attempt to resolve the dispute through mutual discussion and good-faith negotiations.

Mediation & Arbitration

If the matter remains unresolved for a period of 30 days from the initiation of the Mutual Amicable Resolution process:

  • The dispute may, if both parties agree, be submitted to Mediation conducted by a mutually appointed neutral facilitator.
  • Failing mediation, either party may opt for Arbitration under the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, and the seat of arbitration shall be Gurugram, Haryana, India. The decision of the arbitrator shall be final and binding on both parties.

Jurisdiction

Subject to the above, all disputes shall be subject to the exclusive jurisdiction of the competent courts at Gurugram, Haryana, India.

26. Intellectual Property Rights

All content made available through WanderOn's platforms including but not limited to tour itineraries, logos, branding, design elements, website layout, marketing materials, images, videos, pricing formats and written content is the exclusive property of WanderOn or its content licensors.

You may not copy, reproduce, modify, publish, repurpose, distribute or commercially exploit any part of our content or materials without our prior written permission. Use of our intellectual property for any unauthorized or competitive purpose is strictly prohibited.

The inclusion of any third-party names, trademarks or logos on our platform is purely for descriptive purposes and does not imply endorsement or ownership. We reserve all rights not expressly granted in these Terms. Any misuse of our intellectual property shall be in violation of applicable law and may result in legal action.

27. Third-Party Links and External Content

Our website may contain links to third-party websites or platforms. WanderOn does not control or endorse the content, services or accuracy of information on such external websites. Accessing any third-party site is entirely at the user's discretion and risk. WanderOn shall not be held liable for any loss, error or misrepresentation arising from information hosted on or accessed through such external links, including those managed by service providers or advertisers.

28. Amendment of Terms

We reserve the right to modify, update or replace these Terms at any time without prior notice. The latest version of the Terms will always be available on our website. By continuing to use our services after any updates, you agree to be bound by the revised Terms. It is your responsibility to review the Terms regularly to stay informed.

29. Entire Agreement & Severability

Entire Agreement:

These Terms and Conditions constitute the entire agreement between the client and WanderOn with respect to the subject matter herein and supersede all prior communications, representations or agreements whether oral or written relating to the services offered.

Severability:

If any provision of these Terms is found to be unlawful, void or for any reason unenforceable under applicable law then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. The remaining Terms shall remain in full force and effect as if the unenforceable portion had never been a part of them.
